1. Introduction to PartyPeers
Welcome to PartyPeers! These Terms of Service (“Agreement”) are a legally binding contract between you (“User” or “You”) and PartyPeers, LLC (“PartyPeers,” “we,” “us,” or “our”). This Agreement governs your use of all PartyPeers services, including our features, apps, technologies, and software (collectively, the “Services”), unless otherwise stated in separate terms. PartyPeers is a social platform for adults of legal drinking age to connect, exchange monetary gifts for personal use, and promote generosity and good vibes within the community. Your membership begins once your user account is reviewed and activated by our administrator and continues as long as your account remains in good standing. Most PartyPeers services are free to use, though certain bank transfer or processing fees may apply. Our primary revenue comes from advertisements shown on the platform. These ads are personalized based on your activity and preferences, but we do not sell your personal data or share personally identifiable information (like your name or email) with advertisers—unless you’ve given us permission. Advertisers define the audience they want to reach, and we serve those ads to relevant users. We also provide advertisers with performance analytics to improve their campaigns. These Terms define the legal agreement between you and PartyPeers, LLC, outlining the conditions for accessing and using our platform, websites, and applications (collectively, the “Services”). This is a legally binding agreement, so please read it carefully. PartyPeers is intended exclusively for users who are of legal drinking age in their location of domicile. If you do not meet the legal age requirement in your area, you are not permitted to create a PartyPeers account or use our Services.3. Acceptance of These Terms
By accessing or using our website or mobile application (the “Services”), you confirm that you have the legal capacity to enter into a binding agreement with PartyPeers, LLC, and that you accept and agree to comply with these Terms of Service. Your use of the Services is also governed by our Privacy Policy and any additional guidelines posted on the platform or within the relevant app store. These documents are incorporated into this agreement by reference. By continuing to use our Services, you consent to the practices described in the Privacy Policy. If you’re using the Services on behalf of a business or other legal entity, then “you” refers both to you as an individual and to that organization. You affirm that you are authorized to accept these Terms on behalf of the business and bind it to this agreement. The business or entity is fully responsible for your actions and those of any employees, agents, or affiliates using your account. By accessing or using our Services, you indicate your agreement to these Terms. Continued use after any changes means you accept the updated Terms. If you do not agree, you must stop using the Services. Unless you are located in the European Economic Area, the United Kingdom, or Switzerland (“Europe”), you may be subject to additional applicable policies. In the event of any conflict, these Terms will control and be interpreted at our sole discretion. For your records, we recommend saving or printing a copy of these Terms. The English version is legally binding; any translations are for convenience only, and in case of a conflict, the English version will prevail.4. Affirmation of Agreement
By creating and maintaining an active PartyPeers account, you acknowledge that you are entering into a legally binding agreement and accept all terms outlined in this document, including any referenced or related policies. If you do not agree to these Terms, do not create or continue using a PartyPeers account.5. Modifications to Terms and Services
This Agreement is governed by the laws of Laramie County, State of Wyoming, USA, excluding conflict-of-law principles. It represents the complete agreement between you and PartyPeers regarding the subject matter herein and supersedes all prior communications—except for our Bylaws, which remain fully integrated into this Agreement. PartyPeers reserves the right to modify these Terms, our Services, or your access rights at any time. Changes may apply to individual users or to the entire community. Any updates will become effective either upon being posted to the PartyPeers website or upon direct notice to you, whichever comes first. We may revise these Terms periodically—for example, to reflect new features, service integrations, or legal requirements. We’ll make reasonable efforts to notify users of material changes, such as by posting a notice on the platform. However, you are responsible for reviewing the Terms regularly. The “Date of Last Revision” at the top of the Terms indicates the effective date. Your continued use of the Services after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of the Services. PartyPeers also reserves the right to change, suspend, or discontinue any part of the Services—temporarily or permanently—at any time, with or without notice. We will not be liable for any resulting claims, losses, or damages.6. Account Holder Conduct and Gifts of Money
6.1 Account Holder Conduct
To access and use PartyPeers Services, you may be required to link a valid payment method (your “Payment Instrument”) to your account (your “Billing Account”). This may include credit card, debit card, or bank information. By doing so, you affirm that the information provided is accurate, current, and that you are authorized to use the selected Payment Instrument. You acknowledge that all “gift of money” transactions—including those in response to “Buy Me A Drink” requests—are final and non-refundable. PartyPeers works with third-party payment processors to handle all transactions securely. By using the Services, you consent to your payment data being processed, stored, or shared as needed to fulfill transactions in accordance with our Terms of Service and the terms of our payment partners.6.2 Gifts of Money
All gifts of money made through PartyPeers are voluntary and at your own discretion. When gifting money to another member, you understand that the recipient may use those funds however they choose. There is no obligation for them to spend the money on a beverage or any specific item, regardless of what the phrase “Buy Me A Drink” or similar language may suggest. Phrases like “Buy Me A Drink,” “Buy Me A Beer,” or “Buy Me A Cake” are lighthearted slogans used for entertainment and user engagement on the platform. They are not to be taken literally or as a contractual offer for any specific product or service.7. Account Suspension or Termination
At PartyPeers, we strive to maintain a safe and welcoming environment where members can confidently interact and make personal gift requests. To protect our community, we reserve the right to suspend or terminate access to our Services under specific circumstances. We may suspend, disable, or permanently delete your account if, at our sole discretion, we determine that you have clearly, seriously, or repeatedly violated our Terms of Service, Privacy Policy, or Community Standards. This includes—but is not limited to—abuse, fraud, or infringement of intellectual property rights. Your account may also be removed if:- You repeatedly violate the rights of others.
- Your account remains inactive or unverified for an extended period.
- We detect unauthorized access and cannot confirm your ownership.
- Legal, technical, or safety-related issues prevent us from maintaining your account.
8. Affirmative Action and Supplemental Terms
8.1 Affirmative Action
By registering for a PartyPeers account and maintaining active membership, you are affirmatively agreeing to be legally bound by our Terms of Service, including any referenced or supplemental documentation. If you do not agree to these Terms, please do not create a PartyPeers account.8.2 Supplemental Terms for Specific Devices
Depending on your device and the app store used, additional terms may apply as outlined below:Apple Devices (iOS / App Store)
- These Terms are between you and PartyPeers; Apple is not a party.
- License is personal, limited, and subject to Apple’s App Store Terms.
- Apple offers no maintenance or support for the app.
- Warranty claims should be directed to Apple (if applicable).
- Apple is not liable for legal claims, compliance, or IP issues.
- You confirm you are not on any U.S. restricted list or embargoed country.
- Apple may enforce these Terms as a third-party beneficiary.
Windows Devices (Windows Phone Store)
- You may install the Platform on up to five Windows-enabled devices.
- Microsoft, your phone maker, or carrier is not responsible for support.
Amazon Devices (Amazon Appstore)
- If conflicting, Amazon Appstore EULA Terms take precedence.
- Amazon is not liable for compliance with these Terms.
Android Devices (Google Play Store)
- In case of conflict, Google Play Terms override PartyPeers terms.
- Google is not responsible for compliance or enforcement actions.
9. Arbitration Clause and Waiver of Rights
NOTICE: These Terms include an arbitration clause and a waiver of rights to bring a class action against PartyPeers or its affiliates. Except for certain legal exceptions, all disputes involving our Services will be resolved through binding individual arbitration. YOU AND PARTYPEERS WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.
9.1 Scope of Arbitration Agreement
After attempting informal resolution, any unresolved claims related to your use of PartyPeers will be resolved by binding individual arbitration. This applies to current and past claims, except those not legally subject to arbitration. Small claims court remains available where applicable, but if transferred or appealed, arbitration applies. Mixed cases will see non-arbitrable claims stayed until arbitration concludes.
9.2 Arbitration Rules and Forum
This agreement is governed by the U.S. Federal Arbitration Act (FAA). To begin arbitration, you must submit a signed demand to National Arbitration & Mediation (NAM) and send through partypeers.com/contact. Include all required details like claim number, timeline of dispute, contact info, and claim description. Arbitrations follow NAM’s rules: namadr.com.
If over 100 similar claims are filed by the same firm in a 30-day period, they may be batched into groups of 100 with one arbitrator per batch. This maintains the individual nature of each claim but streamlines administration.
9.3 Arbitrator Powers
The arbitrator exclusively decides all disputes about this agreement’s enforceability—except for the Class Action Waiver, which is decided by a court. Arbitrators may rule on motions, award damages, and issue written decisions. All awards are binding only between the parties and must follow applicable law.
9.4 Waiver of Jury Trial
You and PartyPeers waive the right to a trial by jury or judge, except where otherwise stated.
9.5 Waiver of Class or Consolidated Actions
You agree not to pursue claims as part of a class, collective, or representative action. If any part of this waiver is ruled unenforceable, class claims must be resolved in court, while remaining claims continue in arbitration. This does not prevent participation in class-wide settlements.
9.6 Opt-Out Procedure
New users may opt out within 30 days of accepting these Terms. Contact partypeers.com/contact with your full name, email, profile screenshot, state of residence, and an opt-out request. Only individual opt-outs are accepted. If you’ve accepted a prior version of this clause and didn’t opt out then, you cannot do so now. Previously valid opt-outs remain honored.
9.7 Survival
This Arbitration Agreement remains in effect even after you stop using PartyPeers.
FINAL NOTICE: By using PartyPeers, you agree to resolve all disputes through binding individual arbitration and waive any right to a jury trial or class action. Please review this section carefully.
10. California Consumer Rights Notice
Under California Civil Code Section 1789.3, California residents using PartyPeers Services have the following consumer rights: The Complaint Assistance Unit of the Division of Consumer Services at the California Department of Consumer Affairs can be contacted in writing. For more information or to submit complaints, visit: https://www.dca.ca.gov/about_us/contactus.shtml. PartyPeers Services are offered only to individuals aged 21 or older. If your age verification is invalid, your account may be suspended or removed. If you are a California resident under 21 years old, you may request removal of any User Content you have posted by emailing us at support@buymeadrink.app. Please include “California Removal Request” in the email subject line. Your request must include a clear description of the User Content you want removed and enough information for us to locate it. We do not accept removal requests via postal mail, phone, or fax. Requests that are not properly labeled or that lack sufficient information may not be processed, and we are not responsible for notices sent incorrectly.11. Disclaimer: User Responsibility and Safety
PartyPeers is a social connection platform designed to help members meet and interact, including for dating purposes. While we provide tools to facilitate connections, PartyPeers does not perform background checks or verify user identities. All users are solely responsible for their interactions and any decisions made through the platform. We strongly encourage you to exercise caution and sound judgment when communicating with or meeting others, especially in person. PartyPeers, its owners, and affiliates disclaim any liability for losses, harm, or damages arising from user interactions online or offline. By using our Services, you accept full responsibility for your own safety and agree that PartyPeers is not responsible for the behavior or conduct of any user or member.12. Conduct and Ethics
PartyPeers is a community built on ethical principles. Through your participation, you gain access to features that enable introductions and interactions with other members. If PartyPeers receives or becomes aware of any complaint—whether from a member or an external party—regarding your conduct, communications, or activities related to the platform, we reserve the right to suspend, terminate, or delete your account at our sole discretion, without prior notice or explanation.13. Chargebacks and Refunds
Occasionally, account holders may dispute charges related to credit card fees, bank fees, transaction fees, processing fees, sales tax, or other surcharges associated with gifts of money made through PartyPeers. These disputes are managed by third-party payment processors such as banks, Adyen, Stripe, or others, and are separate from PartyPeers. Please note that the principal amount gifted to another account holder—the actual “gift of money”—is non-refundable.14. Content Manifestly Made Public by the User
PartyPeers Content: All intellectual property on the PartyPeers platform—including images, text, audio, video, logos, software, and design—is either owned by or licensed to PartyPeers. Unauthorized use of this content is strictly prohibited. You may not copy, distribute, display, or exploit any materials without written permission. By uploading content, you retain ownership of your material but grant PartyPeers a broad license to use it within the platform and in related services. You agree that we may generate revenue from the platform, including your contributions, without any obligation to compensate you. You are granted a limited, non-transferable license to access and use PartyPeers for personal, non-commercial purposes. This license may be revoked at any time. You view other users’ content at your own risk. PartyPeers is not responsible for the accuracy, reliability, or usefulness of content uploaded by others.14.1 User-Generated Content
You may upload text, images, audio, video, and other content. You must have the necessary rights and permissions to share this content. By submitting User Content, you grant PartyPeers a royalty-free, perpetual license to use and distribute it across the platform and through third-party services. You must not submit confidential or proprietary content. You remain responsible for ensuring that your content is legally compliant and does not infringe on any third-party rights.14.2 Rules for Music and Recording Artists
If you’re affiliated with a PRO or signed to a record label or music publisher, you’re responsible for getting the necessary clearances before uploading music. Being the songwriter or performer alone does not automatically give you the right to share music on PartyPeers.14.3 Through-To-The-Audience Rights
Your content may be displayed by third-party services via PartyPeers. These third parties are not liable to you for the use of your content.14.4. Waiver of Rights to User Content
By posting User Content on PartyPeers, you waive any right to review or approve our marketing or promotional use of that content. You also waive rights of privacy, publicity, and moral rights in relation to the content you share. If moral rights cannot be transferred, you agree never to assert or support any claims based on them.
We may disclose your identity to third parties who claim that your User Content violates their intellectual property or privacy rights. We and our partners have the right to crop, edit, or refuse publication of your content at our discretion. We may also remove any content you upload if it violates our terms or receives complaints, without notice or liability.
To protect your content, we recommend saving copies locally. You control who can see your content by managing your privacy settings. We do not guarantee the accuracy or quality of any User Content.
To report inappropriate or infringing content, contact partypeers.com/contact. We will act quickly to address issues and may suspend repeat offenders’ accounts.
14.5. Feedback and Non-Solicited Contributions
We value ideas from our users, but submitting suggestions (“Feedback”) does not create any obligation on our part. By sending Feedback, you agree:
- We have no obligation to review or use it.
- Feedback is not confidential.
- You grant us full rights to use, modify, distribute, and commercialize it without restriction or compensation.
14.6. Public Display of Information
Some activities on PartyPeers are public by nature. This includes any content you post, such as photos, videos, music, and profile info like your name, email, and biography.
You may also choose to publicly display slogans like “Buy Me A Drink” or “Buy Me A Bottle.” To manage visibility, adjust your Privacy Settings.
Be mindful: Public content can be indexed by search engines and used by others. Think carefully before sharing personal or sensitive information.
14.7. Other Information
If you participate in forums, surveys, or send unsolicited ideas, we consider it “Other Information.” By submitting this, you agree:
- We are not required to keep it confidential.
- We may already be developing something similar.
- We can use, modify, or commercialize it freely.
- You grant us full rights to do so, even after account termination.
- You waive any claims related to moral rights in this information.
We may preserve or disclose this info to comply with law, enforce policies, respond to claims, or protect our community.
15. Data Retention
You understand and agree that PartyPeers is not obligated to store or maintain any data related to your account. We reserve the right to remove user data, terminate accounts, or delete “Buy Me A Drink” requests or posts at any time, with or without prior notice. PartyPeers assumes no responsibility or liability to you or any third party for any loss, claim, damage, or cost arising from such actions.<br>
16. Disclaimer of Warranties
Your use of the PartyPeers Services is entirely at your own risk. All services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, PartyPeers and its affiliates disclaim all warranties, conditions, and representations—whether express, implied, or statutory—including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Nothing in these Terms limits any legal rights you may have as a consumer that cannot be contractually waived or altered.
PartyPeers makes no guarantees regarding the performance, availability, or accuracy of the Services. Specifically, we do not warrant that:
- The Services will meet your expectations or requirements;
- Access to the Services will be uninterrupted, timely, secure, or error-free;
- Any information you obtain through the Services will be accurate or reliable;
- Any technical issues or defects in the platform will be corrected.
Unless expressly stated in these Terms, no other conditions or warranties apply. PartyPeers may change, suspend, limit, or discontinue any part of the Services at any time, for business or operational reasons, without prior notice.

18. Non-Refundable Clause
All purchases made through PartyPeers are strictly final and non-refundable. By completing a transaction, you acknowledge and agree that you waive any right to cancel, revoke, or request a refund for any goods or services purchased on the platform.
This policy applies to all types of transactions including, but not limited to, virtual goods, memberships, subscriptions, digital content, tokens, credits, and other services offered within PartyPeers. Once payment is processed successfully, it is considered fully earned and non-recoverable.
PartyPeers does not provide refunds or exchanges under any circumstances, including but not limited to user dissatisfaction, accidental purchases, change of mind, technical issues related to user devices, or failure to use the purchased item within any timeframe.
We recommend that you carefully review all purchase details, terms, and any associated costs before finalizing your transaction to avoid any misunderstandings. It is your responsibility to ensure the accuracy of any information submitted and the suitability of the purchase.
In rare instances where a purchase is made in error due to a technical malfunction on our part, PartyPeers reserves the right, at its sole discretion, to investigate and consider refunding the amount or crediting your account. Any such determination shall be final and binding.
To report any transaction errors or suspected unauthorized purchases, you must contact PartyPeers support promptly. Failure to notify us within a reasonable period may forfeit any rights to dispute the charge.
Please note that payments made through third-party payment processors or platforms may be subject to their own refund policies, which are separate from PartyPeers’ policies. PartyPeers is not responsible for any refunds or disputes handled by these external parties.
By using PartyPeers services and making purchases, you expressly agree to this non-refundable policy and waive any claims or demands for refunds now and in the future.

To enhance your experience on PartyPeers, we offer several credit packages for purchase to use with gifting, flirts, messaging, and other features not in included in paid membership level service:

21. Membership, Age, and Identity

22. Gifting
22.1 How does gifting work?
When someone views your profile or interacts with you in your profile, they can send you a virtual gift token as a friendly gesture or flirtation. This helps break the ice and spark conversations. You’ll get a notification and can choose to respond, chat, or invite them to a video meeting.
22.2 Can I earn from gifts?
Yes, if you are Platinum member with verified identification. You can earn a 80% minus processing fees (typically 2.95% plus 30 cents per transaction) of the value from digital gifts you receive, making your social experience both fun and rewarding—especially if you actively participate in chats and events.
23. ClubCred™
23.1 What is ClubCred™?
ClubCred™ is your PartyPeers reputation score—a reflection of your vibe, activity, and community respect. It is not based on income or status, but rather on:
- How often you participate in chats
- The number of gifts you’ve given or received
- Your ID verification status
- Your complaint-free record from other users
23.2 Does ClubCred affect my account?
Yes. A high ClubCred can unlock:
- Premium features
- Exclusive chatrooms
- VIP badges
- Visibility boosts
Negative behavior, such as complaints or spamming, will lower your ClubCred.
23.3 ClubCred VIP and VIP+ Program
ClubCred VIP and VIP+ are exclusive recognition levels for PartyPeers members who demonstrate exceptional engagement and positive contributions to the community. These elite badges, managed at clubcred.vip, represent a higher tier of social standing within PartyPeers.
Earning Your ClubCred VIP and VIP+ Badges
To earn VIP or VIP+ status, members must consistently engage in activities that boost the platform’s vibrancy and positivity. These include but are not limited to:
- Regular daily logins and active participation
- High message volume in Club Chats and private conversations
- Frequent giving and receiving of positive reactions (likes, hearts, emojis)
- Spending significant time viewing and participating in chatrooms
- Sharing diverse media content (videos, pictures, emojis, virtual gifts)
- Maintaining a low complaint record and following community guidelines
- Participating in platform-wide events, challenges, or themed chats
- Referring new active members to PartyPeers
Difference from Featured Member Status
ClubCred VIP and VIP+ status is distinct from “Featured Member.” While both recognize valued members, ClubCred VIP/VIP+ honors deep engagement and positive influence, offering perks like enhanced visibility, exclusive features, and priority support.

26. Limitation of Liability
To the fullest extent permitted by law, PartyPeers—including our officers, partners, shareholders, employees, contractors, volunteers, and affiliates—shall not be liable to you or any third party for any kind of damages resulting from your use of the Service. This includes both authorized and unauthorized use.
We will not be liable for:
- Lost profits or revenues
- Loss of data, goodwill, opportunity, or reputation
- Indirect, incidental, punitive, or consequential damages
- Legal or attorney fees
Our platform is provided “as is.” While we work hard to deliver the best experience, we make no guarantees that PartyPeers will be free of errors, secure, or available at all times. We disclaim all warranties—express or implied—including those of merchantability, fitness for a particular purpose, and non-infringement.
We are not responsible for others’ conduct on or off the platform, including offensive, unlawful, or inappropriate content.
Limitation of Total Liability: Our total liability to you will never exceed $200, regardless of the cause of action.
We are not liable for losses resulting from:
- Reliance on advertising or sponsorships
- Service changes or feature removals
- Deleted, corrupted, or lost data
- Incorrect or insecure account info
- Using the platform for business or commercial purposes

27. Mobile Services & Text Messages
PartyPeers offers features designed for mobile devices, including the ability to:

- Access certain services via our mobile app
By using these mobile features (“Mobile Services”), you understand that standard data rates, charges, and fees from your mobile carrier may apply. Not all Mobile Services are available across all devices or carriers, and some may be restricted by your carrier.
When you use Mobile Services, you agree that we may contact you about your account via SMS, MMS, or other mobile-based messaging. This may include automated messages.
If you choose to verify your account by selecting “Send Code” via text, you agree to receive automated text messages from PartyPeers at the number you provided. Message frequency varies, and message/data rates may apply. You may reply STOP at any time to opt out—except for texts related to the security of your account.
Please keep your mobile number current. If you change or deactivate your number, you agree to promptly update your PartyPeers account to prevent messages from being sent to someone else.
We will follow any applicable laws or local requirements before messaging you.
28. Malware & Security
While we work to provide a safe platform, we cannot guarantee that PartyPeers will be completely secure or free of bugs, viruses, or malicious software.
You are responsible for safeguarding your own devices. Please ensure your computer, phone, or tablet is properly protected with up-to-date antivirus software and secure settings. We recommend configuring your technology in a way that ensures safe access to PartyPeers and other online services.

35. Password and Account

- Always sign out from your account at the end of each session when using the Services.
If you forget your password, simply click the “Forgot Password” link on the login page at partypeers.com and follow the instructions to reset it. PartyPeers is not liable for any loss or damage resulting from your failure to follow these responsibilities.
36. No Waiver
Failure by PartyPeers to enforce any provision of these Terms does not waive our right to enforce that or any other provision in the future.
37. Modifications to These Terms
This document represents the complete and exclusive agreement between you and PartyPeers regarding the subject matter herein. It overrides all prior or simultaneous communications, proposals, or representations—both written and oral—except for the PartyPeers Bylaws, which are expressly incorporated into this Agreement.
PartyPeers reserves the right to modify these Terms at any time. Any change becomes effective either upon posting at partypeers.com or upon direct notification to you, whichever occurs first. PartyPeers may also revoke the rights or licenses granted to you under this Agreement at its sole discretion.
By continuing to use PartyPeers, you agree to the most current version of our Terms of Service and Privacy Policy. Changes may be made without notice, but we will always post the latest version on this page with an updated revision date.
38. Private Meetings and Events
From time to time, PartyPeers may host or sponsor private gatherings or ticketed events. Participation in these events is entirely optional. If you choose to attend, you are solely responsible for covering any related expenses, including but not limited to admission fees, registration costs, travel, lodging, meals, entertainment, and any incidental costs associated with participation.
40. Prohibited Conduct
You are solely responsible for complying with all applicable laws and tax obligations related to requesting, receiving, or sending gifts of money through the PartyPeers Platform. Additionally, you are fully responsible for all User Content you upload, post, or share.
Gifts requested through the “Buy Me A Drink” or “Buy Me A Bottle” features must not be used to fund vacations, medical bills, or other unrelated expenses.
You may not use the platform to:
- Violate any law or regulation
- Create deceptive, fraudulent, or impossible fundraisers
- Post sexually explicit, graphic, or offensive content
- Support ransom payments, trafficking, vigilantism, or bribery
- Fund or promote illegal drugs or controlled substances
- Engage in hate speech, harassment, or discriminatory behavior
- Sell or promote weapons or related accessories
- Interact with sanctioned countries, governments, or individuals
- Run gambling, betting, or lottery activities
- Engage in get-rich-quick schemes or pyramid schemes
- Offer credit repair, personal loans, or investment opportunities
- Infringe on trademarks, copyrights, or intellectual property
- Post malware, viruses, or privacy/security threats
- Impersonate others or misrepresent your identity
- Spam, solicit, or transmit unauthorized commercial promotions
You also agree to:
- Avoid accepting or sending any suspicious or fraudulent transactions
- Follow U.S. economic sanctions and related restrictions
- Protect your account data and follow reasonable security practices
- Retain transaction records for compliance and auditing purposes

PartyPeers reserves the right to refuse, suspend, or investigate any transaction or user activity that it deems risky, harmful, or non-compliant with these Terms. We may share relevant account or transaction data with appropriate authorities or financial institutions, in accordance with our Privacy Policy.
Additionally, you agree not to:
- Access or interfere with any PartyPeers systems, servers, or connected networks in unauthorized ways
- Collect or publish personally identifiable information of others without consent
- Create fundraising pages for minors without guardian consent, unless funds are directed into a custodial account
- Use another member’s account or impersonate any person or organization
- Post harmful or inappropriate User Content in the wrong categories
- Bypass or manipulate PartyPeers’ payment systems, including self-payments or off-platform transfers
- Upload or transmit viruses, malware, or any destructive software
- Spam the platform with unreasonable numbers of messages or requests
- Use the platform for solicitation or activities inconsistent with its intended purpose
Gift Transactions
- Do not knowingly process suspicious or fraudulent transactions
- Do not act on behalf of sanctioned individuals, entities, or countries
- Maintain strong security practices to protect your transaction data
- Retain transaction records and provide them if requested by PartyPeers
- Fully cooperate with investigations involving fraud, misuse, or abuse
PartyPeers reserves the right to investigate, suspend, or terminate any transaction or account that violates these Terms. We may share information about your use of the platform with law enforcement, regulators, or payment processors as permitted by our Privacy Policy.
41. Indemnity and Release
By using PartyPeers, you agree to release, defend, indemnify, and hold harmless PartyPeers and its affiliates—including their officers, directors, employees, and agents—from any and all losses, damages, costs, claims, fines, penalties, expenses (including reasonable attorneys’ fees), and injuries (including death) that result from or relate to:
- Your use of the PartyPeers platform or services
- Any donation, gift, or fundraiser
- Any User Content you post, share, or transmit
- Your connection to the Services
- Your violation of these Terms of Service
- Your infringement of another party’s rights
PartyPeers reserves the right to assume full control of its own legal defense. You agree to reimburse PartyPeers for all associated legal costs, including attorneys’ fees.
If you are a California resident, you expressly waive the protections of California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that if known by him or her would have materially affected his or her settlement with the debtor or released party.”
If you live in another U.S. state or outside the United States, you also waive any comparable statute or doctrine applicable in your jurisdiction.
42. Individual Account Holders and Charities
Most PartyPeers account holders are individuals requesting personal financial gifts—whether to buy a drink, a bottle, or for any other purpose they choose. These individuals are not nonprofit organizations, and any contributions made to them are not tax-deductible. If an account holder is listed as a nonprofit charity, you should verify their status directly with the organization and speak with your tax advisor regarding any potential deductions. Member Status, on the other hand, is a curated selection managed by the PartyPeers team. These highlighted members are chosen for reasons such as unique profiles, high activity, or participation in specific campaigns or events. The criteria for being featured are determined solely by PartyPeers and are not connected to ClubCred VIP or VIP+ ratings.43. Intellectual Property Rights
At PartyPeers, we respect intellectual property rights and ask that you do the same. By using our Services, you agree to follow our Copyright Policy.
43.1 Service Content, Software, and Trademarks
PartyPeers Services may include content and features protected by intellectual property laws. This includes copyrighted materials, trademarks, patents, and proprietary software (“Service Content”).
Unless we provide explicit written permission, you agree not to:
- Modify, copy, lease, frame, rent, sell, distribute, or create derivative works based on the Service Content
- Use bots, spiders, scraping tools, or similar data collection methods
- Bypass blocks or restrictions (e.g., through proxies or VPNs)
The software powering our Services is owned by PartyPeers and its partners. You may not reverse engineer, alter, distribute, or transfer rights to this software. All rights not expressly granted are reserved.
“PartyPeers” and its associated logos are trademarks of PartyPeers. You may not use our branding without prior written permission. Any goodwill resulting from such use belongs solely to PartyPeers.
43.2 Third-Party Content
PartyPeers is not responsible for content submitted by users or other third parties. This includes any inaccuracies, omissions, or damages resulting from such content.
We reserve the right—but are not required—to remove, block, or allow any User Content at our sole discretion, without notice or liability.
43.3 User Content Submission
You confirm that you have all rights necessary to submit User Content, including rights related to copyright, trademarks, and privacy.
By submitting content, you grant PartyPeers and our partners a nonexclusive, global, royalty-free, sublicensable license to use, display, distribute, store, and promote your content in any format or media now or in the future.
If your User Content includes your name, likeness, or image, you release PartyPeers and its team from:
- Invasion of privacy, publicity, or defamation claims
- Claims arising from alteration, distortion, or visual effects
- Any right to financial compensation or approval of use
If your content features others, you confirm you have their legal consent to share their image or likeness with us.
Your participation and content submission are voluntary, and you will not be paid for your content or its use.
We do not guarantee any specific content will remain available and may remove or block content at any time, without notice, including if it violates our Terms or is flagged by a third party.
44. Jurisdiction
If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain fully effective—unless doing so would undermine the overall purpose of the Agreement. In such cases, the invalid clause will be replaced with a valid, enforceable version that best reflects the original intent. This Agreement is governed by the laws of the State of Wyoming, United States, and will be enforced to the fullest extent allowed under applicable law.45. Governing Law
These Terms of Service are governed by the laws of the State of Wyoming, USA, without regard to conflict of law provisions. You agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Wyoming for any claims or disputes related to these Terms.
46. Termination
PartyPeers may, at its sole discretion, suspend or terminate your account or access to the Services, in whole or in part, and remove any content tied to your account for any reason. This includes inactivity or violation of these Terms. Suspected fraudulent, abusive, or illegal conduct may be referred to law enforcement authorities. We may discontinue all or part of the Services at any time, with or without notice. Termination may occur immediately and without prior notice. PartyPeers may deactivate or delete your account and related data, and block future access. You agree that PartyPeers will not be liable for any damages resulting from termination or suspension of your access.47. Violations
If you believe a user or content violates these Terms of Service, please report it promptly by contacting us at partypeers.com/contact. To assist our investigation, please include the following details in your report:- A detailed description of the violation
- The username or account involved
- URLs or screenshots of the offending content
- Date and time of the incident (if known)
- Any other relevant details or evidence
48. Profile Image, Posts, and Pictures
For the best display, account holder images should be at least 1,200 by 1,200 pixels (300 dpi) Profile pictures with face coverings, facemasks, or content prohibited online—such as pornography—are not permitted on the PartyPeers platform. PartyPeers reserves the right to delete photos at its sole discretion without notice and may suspend or terminate accounts that violate these Terms49. Your Access to and Use of Our Services
Your use of the Services is governed by these Terms and applicable laws. You must not:- Access or use the Services if you are not legally competent or authorized by a guardian.
- Copy, modify, reverse engineer, or create derivative works of the Services or its content.
- Distribute, sell, rent, or commercially exploit the Services without written permission.
- Use the Services for unauthorized commercial purposes, advertising, or spamming.
- Interfere with the operation of the Services or bypass any access restrictions.
- Incorporate any part of the Services into other programs or products without consent.
- Use automated scripts or bots to collect data or interact with the Services.
- Impersonate others or misrepresent your affiliation with any person or entity.
- Harass, intimidate, or promote discriminatory or sexually explicit content.
- Use another person’s account without authorization or create false identities.
- Engage in activities that undermine the integrity of the Services, such as fake reviews or conflicts of interest.
- Upload or distribute malicious software or harmful content.
- Send unsolicited advertising, spam, or other prohibited solicitations.
- Share private or sensitive information of third parties without consent.
- Post content that infringes intellectual property, is defamatory, obscene, or hateful.
- Promote criminal activities, self-harm, bullying, threats, or discrimination.
- Provide advice or opinions for which you are not qualified or licensed.
- Post any material that, in PartyPeers’ sole judgment, is objectionable or harmful.
50. Your Access to and Use of Our Services
Your access to and use of the PartyPeers Services is subject to these Terms and all applicable laws. You agree not to misuse the Platform in any way. Specifically, you may not:- Access or use the Services if you are not fully able and legally competent to agree to these Terms.
- Copy, modify, translate, reverse engineer, disassemble, decompile, or create derivative works of the Services or any part of its content, including source code, files, tables, or documentation.
- Distribute, license, transfer, sell, lease, or rent any portion of the Services, or use the Services for commercial purposes without our written permission.
- Use the Services to promote or facilitate any commercial advertising, solicitation, or spam without express authorization.
- Interfere with or disrupt the normal operation of the Services or bypass security features designed to protect the Platform.
- Embed or incorporate any part of the Services into another product or platform without our prior approval.
- Use bots, scrapers, or other automated tools to collect data or interact with the Platform.
- Impersonate anyone else, misrepresent your identity, or falsely claim affiliation with any person or organization.
- Harass or intimidate users or promote content that is violent, discriminatory, or sexually explicit.
- Use another user’s account or attempt to access our systems without permission.
- Use the Services in ways that conflict with its purpose, such as manipulating interactions or violating community trust.
51. The Permissions You Give Us
To provide and improve PartyPeers, we require certain permissions from you:
51.1 Permission to Use Content You Create and Share
When you upload or share content on PartyPeers — such as photos, videos, or other media — you retain full ownership of your intellectual property rights. Nothing in these Terms removes your rights. You’re free to share your content anywhere.
However, by sharing content on PartyPeers, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to host, use, distribute, modify, copy, display, translate, and create derivative works of your content, solely to operate and improve our Services, and always in accordance with your privacy settings.
This includes permission to store and share content via service providers that help us operate PartyPeers. You can delete your content anytime. When you delete your account, all personal content is also removed unless shared by others.
Note:
- Deletion may take up to 90 days to complete.
- Content sent to trash is automatically deleted after 30 days unless removed sooner.
- Backups and recovery systems may retain deleted content for another 90 days.
In some cases, content may be retained longer if:
- a) Others have reused or reshared it and haven’t deleted it.
- b) Technical limitations delay the deletion (we’ll remove it as soon as feasible).
- c) It’s needed to investigate illegal activity or policy violations.
- d) It’s required to protect the safety and integrity of our systems or users.
- e) We must retain it for legal compliance, including financial recordkeeping.
- f) A judicial or government agency requests it.
In all such cases, your content will be retained only as long as necessary, and the license remains in effect until deletion is complete.
51.2 Permission to Use Your Name, Profile, and Activity for Sponsored Content
You give us permission to use your name, profile picture, and actions (such as likes or follows) in connection with ads and sponsored content that appear across our Services. This is done without compensation.
51.3 Permission to Update Software
If you download or use any PartyPeers software or app, you give us permission to automatically install updates, patches, and improvements as they become available.
52. What’s Going On- Feature
The “What’s Going On” feature on PartyPeers is a simulated activity display designed for entertainment purposes only. All numbers shown are dynamic estimates and do not reflect real-time data or actual platform usage. PartyPeers, LLC makes no guarantees regarding the accuracy, authenticity, or completeness of the information displayed. This platform is intended strictly for individuals who are of legal drinking age in their respective jurisdictions. Underage use is strictly prohibited. Users are solely responsible for complying with their local laws. By using this site, you agree to our Terms of Service.53. Taxes
PartyPeers does not withhold or manage taxes on your behalf. As a PartyPeers account holder, you are solely responsible for complying with any tax obligations related to gifts of money you send or receive through the platform.
This includes all applicable international, federal, state, and local taxes, including any levies based on your net income or gross receipts. PartyPeers does not provide tax advice or file any reports with tax authorities on your behalf.
You are fully responsible for determining what taxes may apply and for collecting, reporting, and remitting them to the proper authorities. We recommend consulting a tax professional if you are unsure of your responsibilities.
54. Severability
If any provision of these Terms is determined to be invalid or unenforceable by a court with proper jurisdiction, that specific provision will be removed. The remainder of the Terms will remain valid, enforceable, and in full effect.
55. LGBTQ+ Legal Disclosure

Our services are designed for use only in jurisdictions where LGBTQ+ lifestyles and public expressions of affection are fully legal. By accessing or using PartyPeers, you agree that:- You are in a country, region, or municipality where same-sex interactions and LGBTQ+ expression are not criminalized.
- You are solely responsible for understanding and complying with your local laws before using our platform.
- You will not hold PartyPeers liable for any consequences arising from use in jurisdictions where LGBTQ+ expression is restricted or unlawful.

14.X Use of Automated Profiles, AI Systems, and Entertainment Interactions
PartyPeers may utilize approximately 1,500 automated system profiles (each, a “Robot Member”) to support and maintain platform functionality. Robot Members may be used for system testing, content updates, community engagement, response simulations, entertainment, and other functions typical of interactive social platforms.- Automated Interactions. Robot Members may send, receive, or otherwise participate in communications with registered users via messages, flirts, virtual gifts, chat functionality, or other interactive features. Such communications may be generated or facilitated by automated systems, including artificial intelligence, and may not originate from a human operator.
- Paid Features & Entertainment Value. Users acknowledge that they may, knowingly or unknowingly, send paid flirts, messages, virtual gifts, or otherwise expend credits on interactions involving Robot Members. Any credits, fees, or payments made for interactions with Robot Members are exchanged solely for entertainment value or companionship and do not create an expectation of real-world meetings, employment, dating, or other personal relationships with a human.
- Limited Refund Policy. Refunds for interactions with Robot Members will be considered only when: (a) the user can identify a specific Robot Member by profile name, and (b) the interaction occurred without the user’s prior knowledge that the profile was automated. Refunds, if approved, will not exceed 100 credits or $100 USD, whichever is less. For example, “I just learned GloryLori is a robot and spent 50 credits” may be eligible. Conversely, “I just learned you have robots and spent 50 credits” will not be eligible. All determinations are at the sole discretion of PartyPeers.
- Purpose and Operation. Robot Members are maintained to promote consistent activity, assist with feature testing and improvements, present simulated engagement to enhance user experience, and perform administrative or maintenance tasks on the platform.
- Disclosure & Consent. By using PartyPeers, you expressly consent to the presence and participation of Robot Members in communications and activities on the platform and agree to be bound by this section. You further acknowledge that PartyPeers has no obligation to identify whether a profile is automated or human beyond any disclosures PartyPeers elects to display.

57. Entire Agreement
These Terms of Service constitute the full and exclusive agreement between you and PartyPeers, LLC, superseding any previous understandings or agreements regarding your use of our products, services, and platforms.
Some of our services may include supplemental terms. If you use those features, the relevant supplemental terms will apply and form part of this agreement. For example:
- Commercial use is governed by our Commercial Terms.
- Posting music-related content requires compliance with our Music Guidelines.
In the event of a conflict between these Terms and any applicable supplemental terms, the supplemental terms will control where they conflict.
If any part of these Terms is found unenforceable, it will be amended to the minimum extent needed to be enforceable or severed entirely if necessary. The rest of the Terms will remain in effect. Our failure to enforce any part does not waive our rights. Any changes or waivers must be in writing and signed by us.
